Maryland rules that affect a website

These are Maryland's own rules, on top of anything that applies across the US. They are a starting point for questions, not tax or legal advice.

  1. §1

3% tax on custom webpage design since July 1, 2025

Maryland applies a 3% sales and use tax to data and IT services, and the Comptroller lists custom webpage design, custom computer programming and web hosting among them. Contracts signed before July 1, 2025 are not taxed. Ask every studio whether its price includes this tax, and check with the Comptroller of Maryland if you are unsure how it applies to you.

  2. §2

Renewals, change orders and software subscriptions

The Comptroller treats an automatically renewing contract as a subscription, so each renewal is a separate sale, and a change order that adds work not in the original contract is a new sale. Software as a service sold for individual use is taxed at 6%. When you budget for a monthly care plan or extra pages, ask how tax is shown on each invoice.

  3. §3

    Maryland Online Data Privacy Act

The act took effect on October 1, 2025. It covers businesses that operate in Maryland or target its residents and, in the previous calendar year, handled personal data of at least 35,000 consumers, or of at least 10,000 while earning over 20% of gross revenue from selling personal data. If your site may reach that, ask how its forms, analytics and ad tracking collect data and how people can use their privacy rights.

  4. §4

Breach notice: Attorney General first, customers within 45 days

A business holding personal information of Maryland residents must investigate a breach and, unless misuse is unlikely, tell the people affected within 45 days of finding out. Before that, it must notify the Office of the Attorney General. A business that keeps the data for someone else, such as a host, must tell the owner within 10 days. Ask who would spot a breach on your site and who would tell you.

What moves the price

Six things that decide the cost

Storvexa Your quote, line by line

  1. 01

    Pages and content

Five pages cost less than twenty. Writing the copy, finding photos and moving content from an old site all take time, so say up front who supplies them.

  2. 02

    Theme or custom code

A premium WordPress theme is the quickest and cheapest route. A site written in our own code costs more, loads faster and has no page-builder plugins to keep updating.

  3. 03

What the site has to do

A contact form is simple. Online booking, payments, client logins or a shop each add work, because each has to be built, tested and kept safe.

  4. 04

    Languages and markets

Every extra language means translated pages and its own search setup. Prices in more than one currency add a little more.

  5. 05

    Connections to your tools

Linking the site to a CRM, a booking calendar, an accounting tool or a payment provider is quoted per connection, after we have seen what the tool allows.

  6. 06

    Speed and search work

Basic Google setup comes with every site. Full on-page SEO, a Google Business Profile and analytics come with the custom-coded package.

Questions from Maryland businesses

Asked before anyone asks for a quote.

Ask us anything else

It depends on the number of pages, the features and whether the site uses a WordPress theme or is custom-coded, and ongoing care is a separate monthly cost. Since July 1, 2025 Maryland also adds a 3% sales and use tax to custom webpage design. Compare quotes on what they include and on whether that tax is already in the price.

Yes. Since July 1, 2025 the Comptroller of Maryland has treated custom webpage design as a data or IT service taxed at 3%. Web hosting is on the same list. Contracts signed before that date are not taxed, but renewals and new change orders can be. Check the Comptroller's Technical Bulletin No. 56 or ask a tax adviser how it applies to you.

Only if, in the previous calendar year, you handled personal data of at least 35,000 consumers, not counting data used only to complete a payment, or of at least 10,000 while earning over 20% of revenue from selling data. Count what your forms, shop and tracking collect, and check with a lawyer if you are close.

If personal information of Maryland residents may be misused, you must tell the Office of the Attorney General first and then the people affected, within 45 days of finding out. A business that keeps the data for you, such as a host, must tell you within 10 days. Agree in writing who watches for breaches and who reports them.

Not directly. The tax is owed by companies with at least $100 million in global annual revenue that earn at least $1 million from digital ads in Maryland, not by small businesses that buy ads. When you plan ads for your new website, ask the ad platform whether its invoices add any Maryland-related fee.
